Terms of Sales

The acceptance of the General Conditions of Sale constitutes a legal agreement between c . keip and the customer.  The customer agrees to use the services of c . keip in accordance with the following stipulations:

1. Object

c . keip , author photographer, registered with the Tax and Business Service  (SIE) of Aix en Provence  Sud under the number 822 699 369 00010, offers the sale of numbered works, as well as the transfer of rights to broadcasters.

These general conditions of sale and the photographic contract are inseparable. They constitute the contractual framework between c . keip and the customer who undertakes to sign them.

c . keip reserves the right to modify these general conditions of sale at any time. The conditions thus modified will apply to any order placed after the date of modification, including any additional order or related to a previous order.

2. Reservation of  Studio photo reports

The reservation of a photographic service is made exclusively by telephone, by  e-mail, according to the contact information provided on the website, or via the online store of the website www.ckeip.com,  subject to availability of  photographer. The reservation of the photo sessions will only be final upon receipt of a confirmation e-mail and subject to the payment of a 50% deposit (payment by check, cash, bank card or Paypal), no deposit for mini-sessions. In the absence of payment within 10 days of the confirmation email, the reservation will be purely and simply cancelled.

2bis. Gift voucher booking

 

Gift vouchers are payable by check, transfer, bank card  or cash. Full payment will be requested when ordering. The beneficiaries of the gift voucher will have a period of 6 months to carry out the service. Gift vouchers are neither exchangeable nor refundable. Gift vouchers are sent within 7 days of receipt of payment.

 

3. Course of a photo shoot

The appointed time  must imperatively be respected, otherwise the session will be shortened accordingly. It is strictly forbidden to take photos with a mobile phone, a tablet, a camera or any other equipment during the photo shoot (unless previously agreed by the  photographer).

4. Price and Payment Balance

The prices are those valid on the date of the order, indicated in euros all taxes included (VAT not applicable, art. 293B of the CGI). Sale prices do not include shipping costs. Travel costs may apply. They must be paid in addition. The balance will be paid no later than the day of the service, failing which the service cannot be performed. c . keip accepts payment by cheque, cash, credit card, and bank transfer. Checks should be made payable to christophe keip. Transfers must be to the account of c . keip a week before the performance. In the event of non-payment or late payment, no photo/product will be delivered until the balance has been received.

5. Submission of photographs / commissioning of photographic work

The photographs will be given to the customer after receipt of payment and collection of the balance, in accordance with the terms of the order within 1  at 5  weeks depending on products and suppliers. Product orders (prints, albums, enlargements, cds/dvds, etc.) should be collected from the following address: Christophe Keip, 2265 chemin Albert Guigou, 13290 Aix-en-Provence. Delivery is however possible at the customer's expense exclusively by letter followed or colissimo. The delivery times mentioned are only indicative and may possibly be modified. c . keip can not be held responsible for the consequences due to a delay in delivery or loss of parcels on the part of the carrier. In the event of non-receipt of a package within the time indicated, an investigation is conducted with the carrier and may take several days. During this period, no refund or return can be made. In accordance with article 121-20-2 of the Consumer Code, the right of withdrawal cannot be exercised for these products, considered to be personalized.

5bis. Discharge of responibility

c . keip cannot under any circumstances be held liable for direct or indirect damage resulting from the use of the media (cd/dvd/usb key or other) provided, including in the event of loss of data or information. The customer will renounce to engage the responsibility of c . keip in the event of destruction or loss of information and/or files, or any other damage that may be caused to the medium. He strongly advised you to make regular copies and backups of your files. In the case of printing prints in a lambda laboratory, c . keip declines all responsibility for the result obtained, only guaranteeing the prints made by the studio. Similarly, the quality of digital files may not be optimal on an uncalibrated screen, c . keip cannot be held responsible for this.

 

6. Right of withdrawal and cancellation

 

The customer has a withdrawal period of fourteen working days from the day after the day of the conclusion of the order and therefore of its payment. Any withdrawal decision made within the time limit will be subject to reimbursement of the amount actually paid. However, no refund will be made if the service has been performed in whole or in part with the customer's agreement, before the expiry of the withdrawal period. After this period of 14 days, in accordance with legal provisions, the amount of the deposit will not be refunded. It covers the shortfall of a lost photographic service.

 

7. Adverse weather conditions / Force majeure / Technical problem and accident

 

In the event of climatic conditions making it impossible to carry out the service (e.g. shooting in natural light), the obligations of  c . keip will be suspended, without terminating the contract and without this incurring its liability. No refund, even partial, will be made. A new date will be scheduled. c . keip reserves the right to cancel a photographic service in the event of force majeure (irrepressible and/or unforeseeable external event). Such cancellation can neither engage its responsibility nor give rise to the payment of damages for any reason whatsoever. In the event of a technical problem with the photographic equipment or any accident during the service preventing c . keip to deliver the work requested, the full amount will be reimbursed within 30 working days from the day after the day of the service, without however giving rise to the payment of damages for any reason whatsoever.

 

8. Intellectual Property

 

The use of the photographs taken is subject to the legal provisions in terms of copyright and related rights. Even after transfer of the digital files, the photographs remain the intellectual property of the  photographer and are not free of rights. No raw file is delivered. The delivery of the photographs entails the transfer of the right of reproduction of the photographs on any medium and any format as well as the right of representation within the limits of the description which is made on the invoice or the order form and only in the private and family. The client is required to respect the moral rights related to the works of c . keep . Image post-processing and shooting are unique to c . keip and are an integral part of his work, his style and his artistic universe. c . keip alone decides on the post-processing to apply. c . keip reserves the right to use, unless advised otherwise before the photographic service in writing by the client, the photographs taken from a report or a photo session for commercial purposes in the context of the promotion of its activity (website , blog, social networks, advertisements, exhibitions, etc.). In the event of publication of the photos on the internet by the client, the latter undertakes to distribute the photos as they are, without making any changes to the work of the client.  photographer and to use the files in web format provided to them to ensure the copyright of the author © c . keep . In the event of refusal of publication by the client, public dissemination is not authorized for either party (personal or professional websites, Facebook and other social networks, discussion forums, blogs, etc.).

 

9. Preservation of digital files

 

c . keip undertakes (unless there is a disaster beyond its control such as a defective hard drive, flood, fire or other) to keep the digital files selected and ordered by the customer for 5 years from the date of shooting. Beyond 5 years, the backup of the files is no longer guaranteed and these may be destroyed. Unselected photos are permanently deleted to free up disk space once your order has been delivered. At your request, we can offer you a backup service for all the photos presented of your session (contact us for more information).

 

10. Declaration to the CNIL

 

Declaration of conformity with a simplified standard n°2013353 of 01/12/2016, NS48 Client-prospect files. Retention of your data for a limited period, security and confidentiality. Respect for the rights concerned: information on their right of access, rectification and opposition.

 

11. Applicable law

 

All services provided by c . keip are subject to French law. The parties undertake before any legal action to submit their dispute to a mediator. For all disputes relating to the application of these T&Cs or the services provided by the  photographer, only the commercial court of Aix en Provence will be competent.
